Hi all,
We made an offer, through a Realtor. It was accepted. Then the Realtor thought he could get a second to discount thus making our deal sweeter. We wrote another offer with these changes, it was accepted. The second didnt go for the discount ( after agreeing initially). Now the Realtor says that our first offer is null and void and there is another offer on the table. They still have our 15 dollar earnest deposit and a signed 1st offer. We have a buyer and were ready to close when all of this came about? Now they are saying we have no deal? Is this true?
When we were writing the 2nd offer up, I asked about the chance of the second not discounting and he said if they dont we will just go ahead with the 1st offer. I think I am getting the Realtor shaft here!

If you signed the new second offer than that would void the first offer. You should've written the second offer in such a manner that should the second mortgage company not agree to the discount than buyer and seller agree to revert to the original terms.

You Must Stay In Control, and keep ALL terms in writing! The Realtors verbal agreement to "go back to the first offer" is obviously useless. Not that it helps much, but you should be able to get your $15 back.

"This Agreement replaces the initial Agreement of Sale for the property at____ dated _____, by and between (Seller) & (Buyer)." (or something to that effect.) NEVER void the 1st agreement until they are tied up with the 2nd agreement.Also, you could have just had a mutually agreeable revised Addendum to your 1st offer.

Thanks for the responses, I guess I'll just walk and take my buyer with me. It was good to learn of this. How Funny!
